Halley Berry and Gabriel Aubry will maintain joint custody of their three-year old daughter Nahla after the two squared off in a Los Angeles courtroom on Monday over allegations that Aubry pushed the nanny while holding the toddler.

Social workers recommended that no changes be made in the current custody agreement between the two parents, and the judge appears likely to concur and not grant Berry’s request for a restraining order and/or monitored visitation.

“Social workers recommended that absolutely no changes be made in the current custody agreement, which the judge gives tremendous weight and consideration to,” a source close to the situation tells RadarOnline.com.

“Halle and Gabriel essentially have joint custody of Nahla. DCFS found absolutely no basis to the claims that Gabriel physically assaulted the nanny, or has ever physically abused Nahla.”

“There was nothing found to substantiate the nanny’s claims, and social workers felt that a restraining order that Halle was seeking wasn’t necessary, and would actually harm Nahla by keeping her from her father.”

The court hopes that Berry and Aubry can try to work out their problems as it is in the best interest of their daughter.

“The report does recommend that Halle and Gabriel attend parenting classes together, so that they can co-parent Nahla. The classes will give them the tools to work through their issues, and hopefully become better parents for it,” an insider said.

Gabriel Aubry wasted no time after a court allowed him to have continued contact with his daughter Nahla with ex-girlfriend Halle Berry. He was spotted picking up three-year-old Nahla at a house in Los Angeles on Tuesday.  Nahla held onto Aubry tightly as he carried her past the swarm of paparazzi trying to take their picture.

The custody battle over Nahla reerupted after her nanny Alliance Minder claimed Aubry had pushed her against a door on January 22nd while she was holding Nahla in her arms. Berry took to the Los Angeles court on January 23rd trying to get a protective order placed, so Aubry could no longer visit his daughter.

Aubry is said to believe Alliance has sided with his ex in their ongoing custody issues and claims she has fabricated the pushing claims against him.

As of recent, the court has ruled that Aubry can continue to have contact with his daughter till the investigation is complete and that Nahla may benefit from some therapy sessions.

It is being reported that investigators have suggested their daughter Nahla may benefit from some therapy sessions after her nanny, Alliance Kamden claimed Aubry pushed her while she was holding the Nahla. Nahla was not hurt by the apparent argument.

Halle and Gabriel are due back in court today.

Berry is set to ask a judge to stop the model from having any contact with Nahla until the investigation is complete.

Meanwhile, Aubry is requesting a restraining order against the nanny. Aubry is said to believe Alliance has sided with his ex in their ongoing custody issues and claims she has fabricated the pushing claims against him.
